END USER LICENSE AGREEMENT (EULA)

This End User License Agreement (“EULA”) is a legal agreement between you (“you” or “User”) and Art Lysna (“Art Lysna”, “Licensor”, “we”, “us”, or “our”) for the Art Lysna software application and all digital content accessed through it (together, the “Licensed Application”).

By installing, accessing, or using the Licensed Application, you agree to this EULA. If you do not agree, do not use the Licensed Application.

This EULA supplements our Terms & Conditions (https://artlysna.com/terms-%26-conditions) and Privacy Policy (https://artlysna.com/privacy-policy). If there is a conflict regarding software licensing or content use, this EULA controls.

1. Grant of licence

-------------------

Art Lysna grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable licence to install and use the Licensed Application on devices you own or control, solely for your private, non-commercial use, and subject to your active account status and entitlements.

No ownership is transferred to you. All rights not expressly granted are reserved by Art Lysna.

2. Licensed content — all rights remain with Art Lysna

All content within the Licensed Application remains the original, proprietary property of Art Lysna and/or its licensors.

This includes, without limitation, every write-up, script, narration, audio recording, sound file, image, panorama, video, route, story, character experience, design element, and compilation made available through the app.

Subscribers and purchasers receive access only. They do not receive reuse, reproduction, distribution, or derivative-work rights of any kind.

You may not:

• Copy, record, download for retention, scrape, or redistribute any content

• Publish, broadcast, or share Art Lysna materials on any platform

• Use content in teaching, commercial projects, podcasts, social posts, or AI training

• Create derivative works based on our content

• Remove proprietary notices

Any use outside the app requires prior written consent from legal@artlysna.app.

Unauthorized use may result in account termination and legal action.

3. Restrictions on the software

Except as permitted by mandatory law, you may not:

• Reverse engineer, decompile, or disassemble the Licensed Application

• Modify, adapt, or create derivative works of the software

• Rent, lease, lend, sell, or sublicense the Licensed Application

• Circumvent technical protection measures or usage limits

• Use the Licensed Application to build a competing product or service

4. App Store terms (Apple)

If you obtained the Licensed Application from the Apple App Store, you acknowledge that:

• This EULA is between you and Art Lysna, not Apple.

• Apple is not responsible for the Licensed Application or its content.

• Apple has no obligation to provide maintenance or support.

• In the event of failure to conform to any applicable warranty, you may notify Apple for a refund of the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation.

• Apple and its subsidiaries are third-party beneficiaries of this EULA and may enforce it against you.

Your use must comply with the Apple Media Services Terms (https://www.apple.com/legal/internet-services/itunes/) and App Store rules.

5. Updates

Art Lysna may provide updates, patches, or new versions. Updates may be required for continued use. Updates are licensed under this EULA unless accompanied by separate terms.

6. Term and termination

-----------------------

This EULA is effective until terminated. It terminates automatically if you breach it or if your account is closed. Upon termination, you must stop using the Licensed Application and delete all copies from your devices. Sections on ownership, restrictions, disclaimers, and liability survive termination.

7. Disclaimer of warranties

THE LICENSED APPLICATION IS PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND. ART LYSNA DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

8. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ART LYSNA SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE LICENSED APPLICATION IN THE PRECEDING 12 MONTHS, OR £50, WHICHEVER IS GREATER, EXCEPT WHERE LIABILITY CANNOT BE LIMITED BY LAW.

9. Governing law

----------------

This EULA is governed by the laws of England and Wales. Courts in England and Wales have exclusive jurisdiction, subject to mandatory consumer protections in your country of residence.
